Former FBI Director James Comey is reportedly set to face criminal charges in federal court in Virginia within the next days, according to a CNN‑MSNBC style report released Wednesday.

Comey long stood in President Donald Trump’s crosshairs—Trump dismissed him during the early phase of his first term as FBI Director.

Word of a forthcoming indictment comes shortly after the U.S. Attorney for the Eastern District of Virginia resigned under pressure from Trump, having opposed bringing charges against Comey locally.

That prosecutor, Erik Siebert, was replaced on Monday by Lindsey Halligan, who previously has represented Trump in legal cases.

On Saturday, Trump posted on social media calling Comey “guilty as hell,” railing against what he saw as the failure to press charges against the former FBI chief.

MSNBC correspondent Ken Dilanian tweeted Wednesday, “The full scope of the charges being prepared against Comey is unclear,” adding that insiders expect at least one count will accuse Comey of lying to Congress during his September 30, 2020 testimony, specifically about whether he approved leaking information.

During that Senate hearing, under questioning by Senator Ted Cruz (R‑Texas), Comey reiterated his posture to the Senate Judiciary Committee: he denied authorizing a leak to The Wall Street Journal regarding an October 2016 DOJ probe into Hillary Clinton’s email practices.

Dilanian (co‑reporting with Carol Leonnig) also noted that the statute of limitations for a lie to Congress charge would expire next Tuesday.

In a 2020 letter to the Justice Department, Cruz claimed that former Deputy Director Andrew McCabe admitted authorizing the leak and informing Comey. Cruz contended that McCabe claimed Comey approved after the fact, while Comey denied any knowledge or approval.

“These statements are irreconcilably contradictory,” Cruz wrote. “One of them is lying under oath—a federal crime.”

CNBC has asked Comey’s book publisher for comment on the MSNBC allegations. The White House, Justice Department, and U.S. Attorney’s Office for the Eastern District of Virginia have not responded to CNBC’s request.

Trump, in a Truth Social post directed at Attorney General Pam Bondi, declared that Comey, New York AG Letitia James, and Senator Adam Schiff (D‑California) are all “guilty as hell” but “nothing is going to get done.”

He criticized the appointment of the Virginia U.S. Attorney (referring to Siebert), calling him “a Woke RINO … never going to do his job” and said that prominent Senate Democrats had pressured him. Trump dismissed Siebert’s account that he resigned voluntarily, asserting that he was terminated, and claimed a “GREAT CASE” exists against Comey. He called for immediate justice and lambasted repeated attempts to indict or impeach him as baseless.
